The terms that govern access to and use of the Swipe It Hire platform.

1. Agreement to These Terms

These Terms of Service govern access to and use of Swipe It Hire's website, applications, employment marketplace, employer tools, software, and related services.

By creating an account, accessing Swipe It Hire, or using the platform, users agree to these Terms of Service and acknowledge the Privacy Policy.

Users who do not agree with these Terms should not use the platform.

2. Eligibility

  • Swipe It Hire is not the employer of individuals hired through the platform.
  • Swipe It Hire is not an agent of job seekers.
  • Swipe It Hire is not an agent of employers.
  • Swipe It Hire does not guarantee employment.
  • Swipe It Hire does not guarantee interviews.
  • Swipe It Hire does not guarantee candidates.
  • Swipe It Hire does not guarantee applicant qualifications.
  • Swipe It Hire does not guarantee job availability.
  • Swipe It Hire does not make final hiring decisions for employers.

Users are responsible for conducting their own appropriate due diligence.

4. User Accounts

Users agree to:

  • Provide accurate information
  • Keep account information current
  • Protect login credentials
  • Not share credentials with unauthorized individuals
  • Notify Swipe It Hire of suspected unauthorized access
  • Use the account only for lawful purposes

Accounts may not be sold, transferred, impersonated, or misrepresented.

5. Job Seeker Responsibilities

Job seekers are responsible for the accuracy of:

  • Profiles
  • Resumes
  • Employment history
  • Education
  • Certifications
  • Licenses
  • Skills
  • Qualifications
  • Applications
  • Screening responses
  • Messages
  • Information submitted to employers

Fraudulent information or impersonation may result in account suspension or termination.

6. Employer Responsibilities

Employers are responsible for:

  • Job postings
  • Job descriptions
  • Compensation information
  • Job requirements
  • Hiring criteria
  • Candidate evaluation
  • Interviews
  • Employment offers
  • Hiring decisions
  • Background screening
  • Employment eligibility procedures
  • Compliance with employment laws
  • Compliance with anti-discrimination laws

Employers must not use Swipe It Hire to engage in unlawful discrimination.

7. Job Posting Rules

Employers may not post:

  • Fake jobs
  • Fraudulent jobs
  • Misleading jobs
  • Illegal employment opportunities
  • Unlawfully discriminatory job postings
  • Pyramid schemes
  • Jobs created primarily to collect personal information
  • Jobs requiring unlawful payments from candidates
  • Unrelated advertisements
  • Malicious content

Swipe It Hire may remove, suspend, reject, investigate, archive, or close job postings that violate platform rules.

8. Candidate Information

Employers may use candidate information only for lawful recruiting, hiring, employment, workforce planning, or directly related legitimate business activities.

Employers may not:

  • Sell candidate information
  • Harvest candidate data for unrelated marketing
  • Publicly disclose private candidate information without authorization
  • Use candidate information for unlawful discrimination
  • Use candidate information for fraudulent purposes

9. Automated and AI-Assisted Features

Swipe It Hire may provide automated or AI-assisted features for:

  • Job discovery
  • Candidate organization
  • Search
  • Resume assistance
  • Cover letter assistance
  • Recruiting administration
  • Candidate review
  • Information summarization
  • Content generation

Automated output may be incomplete or inaccurate.

Users are responsible for reviewing automatically generated content before relying on or submitting it.

Employers remain responsible for lawful candidate evaluation and employment decisions.

10. No Employment Guarantee

Swipe It Hire does not guarantee:

  • Interviews
  • Employment
  • Job offers
  • Employer responses
  • Applicant availability
  • Applicant qualifications
  • Job availability
  • Hiring results
  • Accuracy of all employer representations

11. Fees and Paid Services

Certain Swipe It Hire services may require payment.

When paid services are offered, clearly display:

  • Price
  • Billing frequency
  • Renewal terms
  • Cancellation terms
  • Applicable taxes

Do not activate recurring billing without clear disclosure.

Users authorize applicable charges when completing a paid transaction.

Fees already incurred may be nonrefundable unless otherwise required by law or stated in the applicable purchase terms.

12. User Content

Users retain ownership of content they submit.

Users grant Swipe It Hire a non-exclusive license to host, store, process, reproduce, display, transmit, and format submitted content as necessary to operate the platform.

This includes content used to:

  • Display profiles
  • Display job postings
  • Deliver job applications
  • Deliver messages
  • Provide requested features
  • Maintain platform functionality
  • Protect the platform
  • Comply with applicable law

Users must have the legal right to submit content they upload.

13. Intellectual Property

The Swipe It Hire name, branding, website design, software, graphics, interfaces, proprietary functionality, and original platform content are protected by applicable intellectual property laws.

Users may not:

  • Copy proprietary platform functionality
  • Resell platform access without authorization
  • Reverse engineer restricted platform functionality
  • Circumvent technical restrictions
  • Use Swipe It Hire branding without authorization
  • Reproduce protected platform materials without permission

14. Prohibited Conduct

Users may not:

  • Violate applicable laws
  • Engage in fraud
  • Impersonate another individual
  • Create fraudulent accounts
  • Attempt unauthorized access
  • Interfere with platform security
  • Upload malicious code
  • Circumvent access controls
  • Harvest user information without authorization
  • Spam users
  • Harass users
  • Upload unlawful content
  • Infringe intellectual property rights
  • Use candidate information for unlawful discrimination
  • Abuse automated platform functionality

15. Third-Party Services

Swipe It Hire may integrate with third-party providers.

Third-party services may have separate:

  • Terms
  • Privacy policies
  • Security practices
  • Availability rules

Swipe It Hire is not responsible for third-party services to the extent permitted by law.

16. Platform Availability

Swipe It Hire may:

  • Modify features
  • Add features
  • Remove features
  • Conduct maintenance
  • Restrict functionality
  • Temporarily suspend access
  • Discontinue portions of the service

Swipe It Hire does not guarantee uninterrupted platform availability.

17. Suspension and Termination

Swipe It Hire may suspend, restrict, or terminate accounts for reasons including:

  • Violation of these Terms
  • Fraud
  • Abuse
  • Security threats
  • Illegal activity
  • Nonpayment
  • Risk to users
  • Risk to the platform

Users may close their accounts subject to applicable obligations and record-retention requirements.

18. Disclaimer of Warranties

To the maximum extent permitted by law, Swipe It Hire is provided on an "as is" and "as available" basis.

Swipe It Hire does not guarantee that:

  • The platform will always be available
  • The platform will always be error-free
  • Every job posting will be accurate
  • Every user will be legitimate
  • Every employer will respond
  • Candidates will receive interviews
  • Candidates will receive employment
  • Employers will successfully fill positions

19. Limitation of Liability

To the maximum extent permitted by applicable law, Swipe It Hire and its affiliates, employees, contractors, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the platform.

This may include loss of:

  • Profits
  • Data
  • Business opportunities
  • Employment opportunities
  • Goodwill
  • Expected hiring outcomes

Nothing in these Terms excludes liability that cannot legally be excluded.

20. Indemnification

To the extent permitted by law, users agree to indemnify and hold Swipe It Hire harmless from claims, damages, liabilities, losses, costs, and expenses arising from:

  • Unlawful use of the platform
  • User-submitted content
  • Violation of these Terms
  • Violation of another person's rights
  • Fraudulent conduct

21. Electronic Communications

Users consent to receiving electronic communications necessary to provide Swipe It Hire services, including:

  • Account verification
  • Password resets
  • Application confirmations
  • Employer messages
  • Candidate messages
  • Interview notifications
  • Security notifications
  • Service updates
  • Legal notices

Provide opt-out functionality for marketing communications where applicable.

23. Severability

If a portion of these Terms is determined to be unenforceable, the remaining provisions remain in effect to the extent permitted by law.

24. Entire Agreement
